Terms of Service

The rules for bookings, payments, cancellations, liability, and use of the website.

These Terms of Service (the "Terms") govern your use of the website tropicalpilates.bg (the "Website") and any Pilates classes, credit packages, memberships, merchandise, workshops, events, or other goods or services provided by B&P Co Ltd. (trading as "Tropical Pilates", the "Studio", "we", "us") through the Website or at its studio location (collectively, the "Services").

By creating an account, making a booking, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

2. Definitions

  • "Account" — the profile you create on the Website, identified by your mobile phone number.
  • "Booking" — a reservation for a specific Pilates class at a specific date and time.
  • "Credit" — a unit of prepaid value that entitles you to book one class (of the type for which the Credit is valid), subject to availability and expiry.
  • "Credit Pack" — a bundle of Credits purchased together, typically at a discount.
  • "Class" — a scheduled Pilates session delivered by the Studio.
  • "Customer" — an individual who has registered an Account or made a Booking.
  • "Website" — tropicalpilates.bg and its subdomains.

3. Eligibility

You must be at least 18 years of age to create an Account, make a Booking, or otherwise use the Services online. The Studio may, at its discretion, accept participants under 18 at the studio in person, subject to the parent or legal guardian being present and signing any required documentation on paper.

By creating an Account you warrant that you are 18 or older and that the information you provide is accurate and complete. If we become aware that a Customer is under 18, we will suspend the Account and refund any unused Credits.

4. Account registration

You register an Account by providing your mobile phone number in international format, your display name, and (optionally) your email address. You are responsible for keeping your Account details accurate and up to date, and for the confidentiality of any authentication codes or PINs used to access your Account.

You agree to notify us promptly at pilates@tropical.bg if you suspect that your Account has been accessed or used without your authorisation.

5. Services

Services offered through the Website and at the studio may include:

  • Booking of individual Pilates classes
  • Sale of Credit Packs for use against future bookings
  • Memberships (if and when offered)
  • Workshops, events, and teacher-training sessions (if and when offered)
  • Branded merchandise and other goods (if and when offered)

At any given time, only the Services then made available on the Website or at the studio are offered. We may add, modify, suspend, or discontinue Services at any time, subject to honouring Bookings that have been paid for and not yet performed, and subject to our refund policy.

5.1 Class schedule and availability

The Studio publishes its class schedule on the Website. The schedule is indicative and may change due to operational reasons, instructor availability, public holidays, low enrolment, or unforeseen circumstances. A Booking is confirmed only after the Website displays a confirmation screen and (if an email address is on file) a confirmation email is sent.

5.2 Class capacity

Each class has a limited number of places. When a class is full, the Website will not allow further Bookings for that class. We do not operate a waiting list unless expressly indicated on the Website.

6. Pricing, payment, and VAT

All prices displayed on the Website are in Euro (EUR) and are inclusive of Bulgarian Value Added Tax at the applicable rate. An exchange to Bulgarian Lev (BGN) at the official fixed rate (1 EUR = 1.95583 BGN) may be shown for your convenience.

You may pay for Services through the following methods:

  • Online via the Website, using a debit or credit card processed by Stripe Payments Europe Ltd.
  • At the studio, in cash, by card, or by bank transfer, as recorded by our staff.

For each Booking or Credit Pack purchase, a receipt is issued by Stripe (for online payments) or by our staff (for in-studio payments). A VAT invoice in the name of the Customer or of a business entity can be issued upon request, subject to receiving the necessary invoicing details from you in due time for the relevant fiscal period.

6.1 Credit packs and usage

Credits are valid for one (1) month from the date of purchase. After that period, any unused Credits expire and have no further value. This short expiry is clearly disclosed at the point of purchase and reflected in the price. Expiry cannot be extended except at the sole discretion of the Studio in documented cases of force majeure affecting a Customer.

Credits are personal and non-transferable. They cannot be exchanged for cash except in the circumstances described in the Refund and Cancellation Policy.

7. Cancellation and refund policy

Our full cancellation and refund policy is set out in the Refund and Cancellation Policy, which forms part of these Terms. In summary:

  • Cancelling a class Booking 24 hours or more before class start: full refund to the original payment method or in the form of the original Credit used.
  • Cancelling a class Booking less than 24 hours before class start, or failing to attend (no-show): no refund; the payment or Credit is forfeited.
  • Classes cancelled by the Studio: refund in Credits and/or cash, at the Studio's discretion.
  • Credit Packs: refundable within 14 days of purchase, provided the Credits have not been used (in whole or in part) and were not purchased together with a class Booking. Credits expire one month from purchase.

7.1 EU distance-contract cancellation right

Under the Bulgarian Consumer Protection Act (implementing Directive 2011/83/EU), consumers generally have a 14-day right to withdraw from distance contracts for services. However:

  • Bookings of Pilates classes for a specific date and time are excluded from the 14-day withdrawal right under Article 16(l) of Directive 2011/83/EU (services relating to leisure activities provided on a specific date or period of performance). Our cancellation window in Section 7 applies instead.
  • Standalone Credit Packs (not bundled with a specific-date Booking) are subject to the 14-day withdrawal right until the Credits are used in whole or in part. Once you begin using Credits, you expressly request that performance of the contract begin, and you lose the right of withdrawal in respect of any used Credits in accordance with Article 16(a) of Directive 2011/83/EU.

8. Liability waiver and health

Pilates is a form of physical exercise that involves movement, resistance, and exertion, and like all physical activity carries inherent risk of injury. By creating an Account and participating in classes you acknowledge and agree to the following:

  • You confirm that you are in suitable physical health to participate in Pilates.
  • You will disclose any relevant medical conditions, injuries, pregnancy, or medications to your instructor before each class.
  • You will follow the instructions and guidance of your instructor at all times.
  • You participate in classes at your own risk.

To the maximum extent permitted by Bulgarian law, the Studio excludes liability for injuries or damages arising from the ordinary risks of physical activity, from your failure to disclose a relevant condition, or from your failure to follow reasonable instructor guidance. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our gross negligence or intentional wrongful act, or for any other liability that cannot lawfully be excluded.

The Studio carries public liability insurance as required by the nature of its activity and by applicable law.

9. Code of conduct at the studio

Customers are asked to:

  • Arrive on time; customers arriving more than 10 minutes late may, at the instructor's discretion, be refused entry to a class in progress for safety reasons, without refund.
  • Bring appropriate clothing and footwear (or grip socks, as appropriate); remove outdoor shoes in the practice area.
  • Treat equipment, staff, and other Customers with respect.
  • Refrain from attending classes under the influence of alcohol or recreational drugs.
  • Refrain from attending classes if you have an acute contagious illness.
  • Follow any studio-specific rules posted at the location.

The Studio reserves the right to refuse entry, ask a Customer to leave, or terminate an Account for serious or repeated breaches of this code of conduct. In such cases, unused paid-for Credits will be refunded pro rata; used Credits and forfeited Bookings will not be refunded.

10. Intellectual property

The Website, its content, design, text, graphics, logos, and software are owned by the Studio or its licensors and are protected by copyright, trademark, and other intellectual-property laws of Bulgaria and the European Union.

You may use the Website only as necessary to access the Services. You may not copy, modify, distribute, publicly perform, create derivative works from, or commercially exploit any part of the Website without our prior written consent, except as permitted by applicable mandatory law.

User-generated photography or video taken at the studio will only be used for Studio marketing where the individual(s) depicted have given express consent at the time of capture.

11. Third-party services

Certain parts of the Services rely on third-party providers, including Supabase (database), Vercel (hosting), Stripe (payments), Resend (email), and Slack (internal notifications). These providers have their own terms and privacy policies, which apply to the data they process on our behalf. Our use of these providers is described in our Privacy Policy.

12. Availability of the Website and Services

We make reasonable efforts to keep the Website available and the Services running. However, we do not guarantee that the Website will be available at all times, error-free, or uninterrupted. We may suspend the Website for maintenance or operational reasons.

13. Changes to these Terms

We may change these Terms from time to time. The "Last updated" date at the top of this document indicates when the Terms were last revised. Material changes will be notified to Customers by email (where an email address is on file) and/or by a prominent notice on the Website at least 30 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.

14. Termination

You may terminate your Account at any time by emailing us at pilates@tropical.bg. We may terminate or suspend your Account where you materially breach these Terms, abuse the Services, or engage in conduct that damages the Studio or other Customers. Termination does not affect (a) our right to retain data we are legally required to retain (see Privacy Policy), (b) your obligations that by their nature survive termination (e.g. unpaid balances), or (c) any refunds due under Section 7.

15. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Bulgaria, to the exclusion of its conflict-of-laws rules. Disputes arising out of or in connection with these Terms shall be resolved by the competent Bulgarian courts at the seat of the Company (Varna).

Nothing in this Section limits your rights as a consumer under mandatory Bulgarian consumer-protection law, including your right to bring proceedings in the courts of your place of residence within the EU.

16. EU Online Dispute Resolution

If you are a consumer residing in the EU, you may submit any dispute arising from an online purchase to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

18. Authoritative language

These Terms are published in both Bulgarian and English. In the event of any inconsistency between the two versions, the Bulgarian version governs.
